Sweepstakes Official Rules
- NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. SWEEPSTAKES VOID WHERE PROHIBITED.
- Sweepstakes Period: The Sweepstakes begins at 12:00 p.m. Pacific Time (“PT”) on May 21, 2025 and ends at 11:59 p.m. PT on May 28, 2025 (the “Sweepstakes Period”). To be eligible for the Sweepstakes, entries must be received within the specified Sweepstakes Period. Entries received before and/or after the Sweepstakes Period will not be considered.
- Eligibility: The Gundry MD® Instagram Sweepstakes (the “Sweepstakes”) is only open to legal residents of the United States and the District of Columbia, who are at least eighteen (18) years of age or older at the time of entry. Proof of residency and age may be required. The winner acknowledges that if they enter the Sweepstakes using a fraudulent name and/or other information and/or account, they will be disqualified from the Sweepstakes. Employees of Gundry MD LLC (the “Sponsor”), its affiliated entities, and its advertising and promotional agencies, as well as members of such employees’ immediate families, are not eligible to win. The term “immediate families” includes spouses, domestic partners, children, siblings, grandparents, and grandchildren.
- Agreement to Official Rules: By entering this Sweepstakes, the Entrant (“You”) agrees to abide by the Sponsor’s official rules (“Official Rules”) and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Sweepstakes, You represent and warrant that You are eligible to participate based on the eligibility requirements set forth herein. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content and administration of this The Gundry MD Instagram Sweepstakes.
- How to Enter: Eligible entrants can enter The Gundry MD Newsletter Instagram Sweepstakes during the Sweepstakes Period, by doing the following:
- Sign up for the Dr. Gundry Newsletter.
- Comment on the official giveaway Instagram post telling us that you’ve signed up before the closing deadline of 11:59 p.m. PT on May 28th, 2025.
One comment = one entry. Limit to one entry per person.
As a participant, your entry must fully meet all Sweepstakes requirements, as specified in the Official Rules, to be eligible to win a prize. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsor’s sole discretion.
- Winner Selection/Notification: Three (3) winner(s) will be selected at random following the conclusion of the Sweepstakes Period. Odds of winning depend on the total number of eligible entries received. Potential winner(s) will be contacted by Instagram Direct Message (“Message”) within five (5) business days following the close of the Sweepstakes Period. Failure of a potential winner to respond to the Message within forty-eight (48) hours of sending the Message will result in disqualification. Sponsor reserves the right, in its sole discretion, to either select an alternate winner or not award that winner’s prize. Sponsor’s decisions regarding all matters related to the administration of the Sweepstakes and selection of the winner(s) are final. IF A WINNER VIOLATES ANY OF THESE OFFICIAL RULES, SUCH WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
- Prize: There will be Three (3) grand prize winner(s). Each grand prize winner will receive: $164.40 of Gundry MD products; Polyphenol-Rich Olive Oil ($49.95), Chef’s Select Organic Olive Oil ($19.95), Polyphenol Pearls ($54.95), Sorghum Spaghetti ($7.45), and a signed copy of The Gut-Brain Paradox ($32)—one prize per winner. Sponsor reserves the right to substitute a prize with a similar prize of equal or greater value in the event an original prize is not available for any reason. Each winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). The prizes are non-transferable and non-assignable, with no cash redemptions or substitutions. All prizes will be shipped to the winner via U.S.P.S. and/or electronic mail. Winner(s) will have to provide their address for delivery of products. Sponsor is not responsible for any lost, stolen, misdirected or damaged mail. Prizes lost or damaged in mailing will not be replaced.
- Rights Granted by You: By submitting an entry (e.g., text, video, photo, etc.) into this Sweepstakes, You understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees, successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media now known or hereafter developed, in perpetuity, on a worldwide and royalty-free basis, and without limitation, your submission, name, photo, portrait, voice, likeness, image, and statements about The Gundry MD Instagram Sweepstakes and Gundry MD, and your biographical information for advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, and/or remuneration.
- Data Collection: By entering the Sweepstakes, You agree to the collection and use of your personal information in accordance with Sponsor’s PRIVACY POLICY including BRAND’s follow up with You about this Sweepstakes and other marketing offers.
- Release of Liability: By entering the Sweepstakes, You release and hold harmless the Sponsor, Meta Platforms, Inc., and each of their respective parents, subsidiaries, affiliates, third-party providers, merchants, sponsors, licensors, and agents, as well as their respective directors, officers, managers, members, employees, subcontractors and representatives (collectively, the “Related Parties”) from any and all liability for any injuries, losses, and/or damages of any kind arising from or in connection with the Sweepstakes, the Gundry MD website and/or Instagram feed, or the acceptance, possession, use, misuse, or inability to use any prize won, if any. The Sponsor and its Related Parties provide the Sponsor’s website, Instagram feed, products, third-party products, and third-party websites on an “as-is” basis and make no representations or warranties of any kind, expressed or implied, with respect to the operation of its or any third-party website, or the information, content, products, or third-party products included on such websites and/or platforms. To the fullest extent permitted by law, the Sponsor and its Related Parties disclaim all such representations and warranties, including, without limitation, warranties of merchantability and fitness for a particular purpose.
This release includes, without limitation, statutory and common law claims for misappropriation or violation of participant’s right of publicity. Without limiting the generality of the foregoing, You understand and agree that all rights under Section 1542 of the Civil Code of California, and any similar law of any state or territory of the United States, are hereby expressly waived. Section 1542 reads as follows: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
- Governing Law; Binding Arbitration: The Sweepstakes is governed by the laws of the United States and the State of California. In the event a dispute arises under this Sweepstakes, You hereby consent to binding arbitration under the Commercial Arbitration Rules of the Judicial Arbitration and Mediation Services (“JAMS”), or its surviving successor, at a location in Los Angeles, California chosen by the arbitrator(s). The arbitrator(s) will make a determination as to the prevailing party in any and all claims and controversies submitted to arbitration. A party may enter a judgment upon the award rendered by the arbitrator(s) in the state and federal courts located in or nearest to Los Angeles, California and the parties waive any objection to venue in such courts. Any arbitration of a claim will be on an individual basis. You understand and agree that You are waiving the right to participate as a class representative or class member in any class action lawsuit concerning this Sweepstakes or the subject matter hereof at any time. The arbitrator may not consolidate or join more than one person’s claims. All aspects of the arbitration proceeding, and any ruling decision, or award by the arbitrator, will be strictly confidential for the benefit of all parties. In any arbitration or legal proceeding arising from or related to this Sweepstakes, the arbitrator(s) or court may award reasonable attorneys’ fees and costs to the prevailing party, in accordance with applicable law.
- Miscellaneous Conditions: The Sweepstakes is subject to all applicable federal, state and local laws and regulations, in addition to Instagram®’s Terms of Use. The Sweepstakes may only be entered in or from the United States. Sweepstakes entries originating from any other jurisdiction will be disqualified. Sponsor has the sole discretion to terminate the Sweepstakes at any given time, or to amend these Official Rules at any time for any reason. In the event of an early cancellation, Sponsor reserves the right to award a prize in a random drawing from all eligible entries received before the time of cancellation. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, and/or providers, computer equipment, and/or software, or failure of any entry to be received by Sponsor on account of technical problems, cellular and/or internet service issues, and/or traffic congestion on the Internet or at any website, and/or any combination thereof. If any provision of these Sweepstakes Official Rules is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remainder of the Sweepstakes Official Rules will otherwise remain in full force and effect. You acknowledge that these Sweepstakes Official Rules express your entire understanding and agreement, and that there have been no warranties, representations, covenants and/or understandings made by Sponsor to You except those expressly set forth in these Sweepstakes Official Rules.
- Sweepstakes Results; Alternative Entry: You may obtain a copy of these Official Rules or the Sweepstakes results or submit your name for entry in the Sweepstakes by sending a self-addressed, stamped envelope to: Gundry MD Sweepstakes, 145 S. Fairfax Avenue, Suite 200, Los Angeles 90036
